Oakland Man Killed in Ford Explorer Rollover on Interstate 80

i80albany.jpgALBANY - A Ford Explorer SUV rollover tragically killed a 48-year-old Oakland man Monday morning in Alameda County, Mercury News reported. The accident was reported on eastbound Interstate 80, just west of Buchanan Street, at about 10 a.m. on Monday, April 18, 2011. The victim, identified by the Alameda County coroner's bureau as Napoleon Quintero, was driving a white Ford Explorer with his wife and two children when for unknown reasons, he lost control of the vehicle, causing the SUV to roll multiple times. Quintero's wife suffered a broken leg, and his two children suffered minor to moderate injuries.

Cause of the April 18th Accident

The cause of the SUV rollover accident remains under investigation by the California Highway Patrol At this point, the news reports raise more questions than answers as to what happened. It is not clear why Quintero lost control of his vehicle. Vehicle rollovers can occur for many reasons, from unsafe steering maneuvers to tire blowouts to dangerous road conditions. Hopefully, the investigation by the CHP will provide answers as to why this tragic rollover occurred.

SUV Rollover Accident Liability

Ford Motor Co. and other vehicle manufacturers have paid out hundreds of millions of dollars in verdicts and settlements to victims of SUV rollover accidents and their families. If a design defect in the vehicle is determined to have caused or contributed to the fatal accident, the manufacturer of the car may be liable for the wrongful death of the driver, Napoleon Quintero, and the injuries sustained by his family members in the vehicle with him. Following a fatal Ford Explorer rollover crash such as this April 18th crash on Interstate 80, the family members of the victims of this crash would be well-advised to speak with a California SUV rollover accident lawyer.

Although no money awarded in a verdict or settlement can bring back a loved one's life taken too soon, a personal injury or wrongful death claim can ensure responsible parties are held accountable, and that future similar occurrences may be prevented. Damages awarded in wrongful death claim may include compensation for anticipated future earnings and financial contributions the decedent would have earned, funeral and burial expenses, and loss of love, care, affection, guidance and companionship.

The impact of the rear-end collision forced the Pilot into eastbound traffic where it was struck by the Ford Model A. Speer was ejected from his vehicle and was fatally injured. Brandon suffered minor injuries and was taken to Fremont Hospital. Ashworth was not hurt.

Cause of the Highway 140 Crash

The cause of the April 9th Mariposa County crash remains under investigation by the California Highway Patrol. Fatal Car Accident Wrongful Death Liability

Damages available in a wrongful death claim may include funeral and burial expenses, lost earnings and benefits, and loss of love, care, affection and companionship. Red Bluff Girl Critically Injured in Tehama County Crash

ca99pattersonroad.jpgRED BLUFF -- A 6-year-old Red Bluff girl suffered major injuries in a four-vehicle crash Saturday afternoon in Tehama County, the Record-Searchlight reported. The accident was reported at 12:45 p.m. on April 2, 2011, on Highway 99E just south of Patterson Road. The young girl was a passenger in a 1999 Subuaru driven northbound on Highway 99E by Jerod Gilbert, 24, of Red Bluff. When Gilbert slowed the vehicle to make a left turn onto Patterson road, he was rear-ended by a 1999 Ford driven by Pablo Vasquez, 31, of Gerber. The impact of the rear-end collision caused Gilbert's vehicle to spin into southbound traffic where it was struck by a car driven by John Koga, 19, of Palo Cedro. A 29-year-old Paradise woman, Kristen Horst, was able to avoid the collision, but lost control of her 2010 Subaru and ended up in a grassy field.

Jerod Gilbert, Pablo Vasquez, and Kristen Horst were reportedly not injured in the crash. John Koga suffered minor injuries, as did a passenger in Gilbert's Subaru, Rikki Ramey, 25. A six-year-old girl in Gilbert's Subaru was critically injured and taken to Enloe Medical Center in Chico, and later transferred to UC Davis Medical Center.

The California Highway Patrol is investigating this incident. Based on the news reports, it appears the driver of the Ford who rear-ended Gilbert's vehicle may be responsible for this collision. The CHP surely will look at the speed of all vehicles, possible negligence such as texting and driving or driving under the influence in determining what happened, and who was responsible.

If the driver of the Ford is determined to be at fault here, he may be liable for the injuries the little girl in the Subaru suffered. When negligence or reckless driving cause accidents that result in serious injury to a child, the parents of the victim would be well-advised to seek a consultation with a knowledgeable California car accident lawyer. A skilled attorney can help the family protect their legal rights to hold the negligent parties fully accountable for medical expenses and pain and suffering the family endured as a result of this accident.

If news accounts of the incident are accurate, it is likely that Melissa Ellithorp could have done nothing to avoid this collision. It is unclear why Ortega allowed his southbound vehicle to drift into northbound lanes. Was he distracted? Did he fall asleep at the wheel? Was he driving under the influence? Did something malfunction mechanically? Hopefully, the investigation by law enforcement will reveal exactly what happened, and why.

Car Accident Wrongful Death and Personal Injury Liability

While this car accident remains under investigation, the family members of the three occupants of the Hyundai would be well-advised to consult with an experienced and knowledgeable California car accident lawyer. An attorney who has handled hundreds of personal injury and wrongful death cases arising from head-on collisions similar to this one can closely monitor the official investigation and advise the victims' families of their best course of action to protect their rights. If necessary, an independent investigator can be dispatched to the scene to independently determined what happened and why.
