Second Worker Tragically Died in Lamont Industrial Accident

constructionsafety.jpgKERN COUNTY -- A 22-year-old composting worker was taken off life-support and later died due to his injuries in Kern Medical Center's intensive care unit at about 11:04 a.m. Wednesday, The Bakersfield Californian reported. The worker, Heladio Ramirez, of Arvin, was attempting to help his brother, Armando Ramirez, 16, who collapsed after he was working inside an 8-foot-deep drainage tunnel at Community Recycling and Resource Company in Lamont. While both of them were inside the tunnel, they were exposed to a high concentration of hydrogen sulfide, a naturally produced compost that is deadly and attacks the central nervous system.

The official cause of what happened and why Heladio and his brother were exposed to high levels of hydrogen sulfide remains unclear. Therefore, the industrial accident was reopened by the Labor Commission and U.S. Department of Labor to further investigate this tragic incident, and will look at numerous factors that may have caused the deaths to these two brothers such as proper safety equipment, unsafe work environment, and other negligent or reckless actions of a third party.

ca119.jpgA Los Angeles County man was tragically struck and killed while trying to cross Highway 119 Monday night, the Taft Midway Driller reported. The fatal Kern County pedestrian accident occurred on Highway 119 (Taft Highway), on the west side of the Interstate 5 overpass, just before 6:30 p.m. The Kern County Coroner identified the victim as Roberto Vela Alvarez, 56, of Huntington Park. The cause of the accident remains under investigation. According to the Midway Driller, Alvarez had previously run out of gas, and was walking from the Chevron Station back to his vehicle when he was struck by a westbound truck, thrown into eastbound lanes, and struck by another vehicle.

Who was Responsible?

Based on the very limited information provided in news reports, it is impossible to determine exactly what happened to cause this November 8th Kern County pedestrian accident, or who was responsible. At this point there are more questions than answers. How fast were the vehicles going that struck Alvarez? Could either driver have done anything to prevent the collision? Hopefully the investigation by the CHP will yield answers to these questions and determine exactly what happened.

Pedestrian Accidents and Wrongful Death Liability

Anytime a pedestrian crossing the road is knocked down and killed by a moving vehicle, there are numerous questions and potential liability issues. In situations such as this one, where the cause of a fatal pedestrian accident is unclear, the family members of the victim of a fatal accident would be well-advised to speak to a California pedestrian accident lawyer about their rights in a potential wrongful death claim. The Kern County accident occurred at the intersection of Kern Street (West Side Hwy / CA-33, and 8th Street, at about 8 p.m. According to news reports, a motorcycle was travelling eastbound on Kern Street, while at the same time an SUV was making a left turn from northbound Eighth Street to westbound Kern Street.

Mason was wearing a helmet, authorities reported.

Cause of the Crash

Based on the news reports, it appears that the driver of the SUV pulled out into the path of the motorcyclist. The motorcyclist did not have a stop sign at the intersection, while the driver of the SUV did. However, the official cause of the accident is still under investigation.

Motorcycle Accidents Involving Left-Turns

This type of collision involving a motorcycle with the right of way and a vehicle making a left turn is fairly common. On June 28th, a motorcyclist died in a Butte County motorcycle accident when a teen made a left turn in front of him. In May, a motorcyclist died in a similar motorcycle crash in Madera County involving a pickup truck making a left turn on Highway 41. While these failure-to-yield motorcycle accidents are common, unless excessive speed is involved, they are almost always the fault of the driver of the vehicle making a left turn.

drinking-and-driving-handcuffs.jpg

An intersection accident in Kern County Tuesday night left one person dead, two people with moderate injuries, including a minor, and more than 2,000 southwest Bakersfield residents without power. Police suspect a local firefighter was driving under the influence of alcohol when he ran a red light, causing the deadly DUI collision.

According to ABC23 in Bakersfield, firefighter Mitchell Green, 30, was driving a red Ford pickup truck that collided with a gray Hyundai at Panama Lane and Ashe Road. Green suffered moderate injuries. The driver of the Hyundai, a minor, also suffered moderate injuries and was taken to Kern Medical Center.
