Teenager Crossing Street Struck and Killed by Car in Lodi

lodi-accident.jpgA 14-year-old Acampo girl died early Wednesday morning after she was struck by a vehicle in Lodi, CBS 13 News reported. The San Joaquin County pedestrian accident occurred around 5:45 a.m. on East Highway 99 Frontage Road just north of Woodbridge Road. The girl, who was not identified, was apparently crossing the road with her sister to catch a school bus when she was struck. Her sister, who made it across the road and was not hurt, witnessed the accident. The victim was airlifted to Lodi Memorial Hospital with major injuries, where she died.

Cause of the Accident

The cause of the accident remains under investigation by the CHP. Based on the limited information provided in news reports, it is not clear why the girl was struck. The CHP will surely look at the speed of the vehicle, possible driver impairment or distraction, evidence of braking, such as skid marks, and other factors in determining whether the driver could have prevented the fatal pedestrian accident. At this point, there are more questions than answers as to what happened and why.

Pedestrian Accident Liability

Whenever a pedestrian is struck by a moving vehicle there is always the potential of very serious injury. Pedestrians do not have the protection of a seatbelt, airbag, or steel walls of a vehicle, or even a helmet that a cyclist may have. If the driver of the vehicle is determined to be responsible for the crash, he or she may be liable for the victim's death, including funeral and burial expenses, loss of love, care and companionship and other accident-related expenses. In situations such as this September 1st Lodi pedestrian accident, the parents of the victim may benefit from speaking to a California pedestrian accident lawyer about their legal rights following this accident. A knowledgeable lawyer can review the facts of the accident, explain the unique legal issues relevant to a potential wrongful death claim, and advise the victim's family of their best course of action going forward to protect their rights.

Pedestrian Struck and Killed April 19 in Chico

A Chico man died Monday night, shortly after he was struck by a car at about 8:45 p.m. police reported. The man, identified as 47-year-old James Swopes of Chico, was attempting to cross the Esplanade on foot in the 2600 block when he was struck by a southbound Nissan X-Terra SUV. Swopes was crossing Esplande between the parking lot of Tortilla Flats restaurant on the west side of the road to the area near the Priya Indian Restaurant on the east side.

The driver of the SUV, Julio Amezquita, 87, of Chico, told police he did not see Swopes until it was too late to avoid the collision. Fault and Wrongful Death Liability

Based on the reports of this accident by KHSL News and the Chico Enterprise Record, the cause of the crash is still not clear. If the driver was speeding, he may be responsible. The coroner will also determine whether the pedestrian was under the influence of alcohol or any other drugs. Hopefully the investigation by law enforcement will determine what happened, how fast the Nissan was travelling, and who was at fault. While this crash is being investigated, the family of the man killed would be well-advised to speak to a California pedestrian accident attorney about their possible legal rights in a wrongful death claim.

Elderly Driving Accidents

In any accident involving an elderly driver, there is always the question raised of whether the driver still possesses the skills and ability to drive. Although many elderly people are able to drive safely, maintaining their independence should never come at the price of a innocent pedestrian's life. Even if the elderly driver is not cited by police, depending on the circumstances, he may still potentially be held liable for this accident in a wrongful death claim.

Fresno Man Critically Injured in Hit and Run Pedestrian Accident

ambulance-3.jpgA Fresno man was taken to Community Regional Medical Center with life-threatening head injuries after he was struck by a vehicle in central Fresno on Tuesday night. The hit and run pedestrian accident occurred at about 6:45 p.m. Tuesday, on E. Belmont Avenue and North First Street. Fresno Action News reported the 30-year-old man was thrown about fifty feet following the impact. The driver of the vehicle that struck him did not stay at the scene. Fresno Police said they found the suspect's vehicle several blocks away, but did not find the driver.

Please keep the victim in your prayers as he has suffered very serious injuries. We hope that he makes a full and speedy recovery, and that the driver is located quickly or turns himself or herself in.

Leaving the scene of an accident is against the law. Under the California vehicle code, any accident that involves injury or death mandates that the driver must stop. When a driver leaves the scene of an accident causing property damage, injury or death, the incident is called a hit and run. Often, the party leaving the scene is the at-fault party, but not always. A hit and run can be either a criminal misdemeanor or felony, depending on the seriousness of accident and extent of injuries. The family of the man injured in this accident would be well-advised to consult with a Fresno pedestrian accident attorney for more information about the man's legal rights to compensation. If the driver is not located, the injured man may be able to obtain monetary damages for his injuries from his own insurance policy, if he has one.

The California Highway Patrol is investigating the death of a man who was killed while walking on the side of Highway 1 last week near California State University Monterey Bay. The pedestrian, identified as David Armstrong, 50, of Seaside, was walking on the northbound side of Highway 1, north of Light Fighter Drive just before 8:30 p.m., when he was struck by a passing vehicle. Armstrong was then struck again by several other vehicles and died at the scene of the crash.
