San Diego Injury Lawyers: Failure-To-Yield Can Cause Catastrophic Motorcycle Accidents

Despite the fact that the California Vehicle Code gives motorcyclists the same rights as other motorists, all drivers do not observe the rules of the road. If the driver of a passenger car or commercial vehicle fails to yield to the right-of-way of a motorcycle accident, it can result in a catastrophic and potentially fatal motorcycle accident. When these failure-to-yield collisions occur, negligent motorists may be liable for motorcyclists' injuries, including medical care, lost wages, pain and suffering, and other damages.

Failure-to-yield crashes frequently result from an unsafe or illegal U-turn or left-turn. California Vehicle Code Section 21801 states "The driver of a vehicle intending to turn to the left or to complete a U-turn upon a highway, or to turn left into public or private property, or an alley, shall yield the right-of-way to all vehicles approaching from the opposite direction which are close enough to constitute a hazard at any time during the turning movement, and shall continue to yield the right-of-way to the approaching vehicles until the left turn or U-turn can be made with reasonable safety."

Unfortunately, failure-to-yield crashes are common events in San Diego. In March 2012, a motorcyclist delivering pizza was seriously injured when a pickup truck made a left turn in front of him in the SDSU area, at the intersection of 63rd Street and Montezuma. Another accident ion January 31, 2012 happened at the intersection of Main Street and Vesta Street in the Barrio Logan area, when the driver of a Chevy van making a left turn failed to yield to the right-of-way of the motorcyclist.

Intersection collisions and left-turn crashes involving motorcyclists often result in serious injuries. In the SDSU crash in March 2012, the motorcyclist was taken to the hospital with a fractured pelvis and serious internal injuries. In the crash in Barrio Logan, the motorcyclist suffered a broken femur and broken collarbone. These are just two examples of motorcycle accidents that happen frequently. Orthopedic injuries such as a broken leg may require multiple surgeries, lengthy rehabilitation, and in some cases, may result in permanent disability.

If you have been injured in a San Diego motorcycle accident, it is advisable to seek a consultation with a San Diego motorcycle accident lawyer as soon as possible. A California personal injury attorney who has handled injury and wrongful death claims resulting from failure to yield can provide a free consultation to ensure all of your legal rights are protected and that you are taking the correct steps necessary to recover the maximum financial compensation you need and deserve.
